General Terms and Conditions of Sale

UPDATE TO TERMS AND CONDITIONS - April 12, 2026

"These General Terms and Conditions of Sale (hereinafter "GTC") govern all transactions concluded between Dodeca Diamonds Switzerland and its clients. They specify the terms of ordering, payment, shipping security, and the guarantees of authenticity applied to each piece of fine gemology."

I. Purpose and scope

These Terms and Conditions define the rights and obligations of Dodeca Diamonds Switzerland (hereinafter "the Seller") and its customers (hereinafter "the Buyer") in connection with the sale of products via its website. Any order for products implies the Buyer's unreserved acceptance of these Terms and Conditions in their entirety, which the Buyer acknowledges having read prior to making the purchase.

 

II. Geographical Territory

The products are offered for sale exclusively in the following territories: Switzerland, Europe and International.

 

III. Legal Capacity

The Buyer declares, prior to placing their order: Having reached the age of majority in their country of residence. Having full legal capacity to enter into this agreement under these Terms and Conditions. Being duly authorized to carry out financial transactions related to the offer.

 
IV. Amendment of the General Terms and Conditions of Sale

Dodeca Diamonds Switzerland reserves the right to modify these terms and conditions at any time. The applicable terms and conditions are those in effect on the date the order is validated by the Buyer.

1 - Access to the Site

1.1 The Buyer is personally responsible for setting up the computer and telecommunications means enabling access to the Dodeca Diamonds Switzerland website.

 

1.2 Connection and equipment costs remain the sole responsibility of the Buyer.

2. PRICES
 

2.1 The selling prices of the products displayed on the Dodeca Diamonds Switzerland website are indicated in Swiss Francs (CHF).

 

2.2 VAT : The prices displayed on the product pages are exclusive of tax (VAT). Swiss VAT, at the rate in effect on the date of the order, is calculated and added to the total amount when the shopping cart is finalized or the invoice is generated. Any change in the legal rate will be automatically reflected in the final price charged to the Buyer.

 

2.3 Shipping Costs : The prices shown do not include delivery and secure insurance costs. These are calculated based on the order amount and destination, and are specified to the Buyer before final confirmation of their purchase.

2.4 Price Changes : Dodeca Diamonds Switzerland reserves the right to change its prices at any time. However, the price shown on the validated order form, once VAT and delivery charges have been added, remains firm and final for that transaction.



3. PRODUCT CHARACTERISTICS AND AVAILABILITY
 

3.1 The products offered for sale are those listed on the Dodeca Diamonds Switzerland website on the day of consultation by the Buyer. Each product has a descriptive sheet outlining its essential characteristics.

 

3.2 Offers are valid as long as they are visible on the website, subject to availability. Dodeca Diamonds Switzerland strives to regularly update stock levels.

 

3.3 However, if a product becomes unavailable after an order has been placed, the Buyer will be informed by email as soon as possible and will have the option to cancel their order or choose a replacement product.



4. ORDER AND CONTRACT FORMATION
 

4.1 Product information: In accordance with standard practice in the gemmology trade, the Buyer may view the essential characteristics of the product on the website prior to placing an order (carat weight, clarity, colour, cut, dimensions and components). These technical details are taken from certificates issued by accredited laboratories (GIA, HRD, Gübelin, SSEF), which are considered authoritative.

4.2 Request for further information: The Buyer may, and is encouraged to, contact Dodeca Diamonds Switzerland directly before confirming their order. Upon request, we can provide additional detailed information, supplementary images or a digital copy of the certificate of authenticity for the selected item.​

4.3 Validity of offers and stock:

•   Products in stock: Offers are valid whilst stocks last and are subject to the products being physically present in our warehouses in Switzerland.

•   Products available to order: For items marked ‘available to order’, the sale is subject to confirmation of availability from our partner suppliers. In the event of exceptional unavailability of a product after the order has been placed, the Buyer will be informed immediately in writing and may request the cancellation or exchange of their order.

4.4 Product range and visual representations: Dodeca Diamonds Switzerland reserves the right to modify its product range in accordance with supply constraints. Photographs and graphic representations of the products are as accurate as possible but are for illustrative purposes only. Due to the unique nature of each gemstone and differences in screen display, they shall not engage the Seller’s liability nor affect the validity of the sale.

4.5 Acceptance of the Terms and Conditions: Any order, whether placed via the website or directly (order form/sales contract), implies the Buyer’s full and unconditional acceptance of these Terms and Conditions. The Buyer is required to provide accurate information (surname, first name, billing and delivery addresses, email address).

4.6 Online Ordering Process: The order is considered final as soon as the Buyer clicks on the “Confirm” button. At that moment, they knowingly accept the prices, specifications, volumes and quantities of the products ordered.

4.7 Limited right of cancellation: As a gesture of goodwill, the Buyer has a period of 60 minutes following confirmation to request cancellation of their order by email. After this period, the order is deemed final, subject to confirmation by the Seller.​

4.8 Personalised Direct Sales (Outside the Online Catalogue): This procedure applies to specific requests made by the Buyer (via email or telephone) for stones not included in the ‘Prestige’ range.

4.8.1 Process: Following the request, Dodeca Diamonds Switzerland issues a detailed proposal (free quotation). Upon acceptance in principle, a purchase order or final contract is issued.

4.8.2 Reservation Period (Hold): From the date the purchase order is issued, the stone is held exclusively for the Buyer for 24 hours. During this period, the Buyer may cancel their request free of charge.

4.8.3 Confirmation and Finality: The sale becomes final and binding upon signature of the purchase order and payment (deposit or 100% as agreed). Once this stage is reached, cancellation due to a simple change of mind is not possible.

4.8.4 Non-conformity on receipt: If the stone delivered does not comply with the contract or the certificate, the Buyer must inform the Seller within 48 hours. In the event of proven non-conformity, a return will be arranged with a full refund (including postage and insurance costs), at no cost to the Buyer.

4.9 Customised Search Commissions: A search commission refers to the task entrusted by the Buyer to Dodeca Diamonds Switzerland to identify a specific stone not currently listed in the website’s inventory. As these customised services are governed by a dedicated supporting protocol, the Buyer is invited to contact us directly to receive the ‘Specific Terms and Conditions for Commissions & Prestige’.

4.10 Confirmation and Validity of the Sale: The sale only becomes final upon fulfilment of the following two cumulative conditions:

4.10.1 Confirmation: The sending by Dodeca Diamonds Switzerland of an order confirmation by email.

4.10.2 Payment: The Seller’s actual receipt of the full price (or the agreed deposit). 4.11 Right of refusal and anti-fraud measures: Dodeca Diamonds Switzerland reserves the right to refuse, suspend or cancel any order that is of a fraudulent nature, involves a payment anomaly, or is placed by a Buyer with whom there is a prior dispute. Any order presumed to be fraudulent shall be deemed null and void without the Seller being held liable.

5. Payment Terms
 

5.1 General Principles: Payment for the order is due upon confirmation by the Buyer. All transactions are conducted exclusively in Swiss Francs (CHF). The Buyer warrants to Dodeca Diamonds Switzerland that they have the necessary authorisation to use the chosen payment method.

5.2 Confirmation and Payment Process: To ensure maximum security and the availability of items, the payment process is as follows:

1. Confirmation: Once the order has been registered, Dodeca Diamonds confirms availability and sends the official invoice to the Buyer.

2. Payment Deadline: The total amount must be credited to our account within 24 hours of receipt of the invoice to guarantee the reservation of the product.

5.3 Accepted payment methods:

•    Bank Transfer (Preferred Option): Via our bank in Switzerland. We strongly recommend using Instant Transfer to ensure the 24-hour deadline is met.

•   Mobile & Digital Payments: TWINT, QR-Invoice or secure payment link (Visa, Mastercard, American Express). Security note: Bank transfer is preferred to ensure full traceability of funds and prevent any attempts at credit card fraud, thereby protecting both the Buyer and the Seller.

5.4 Conditions subject to availability:

•    Collection in person (Swiss stock items only): The full amount is due no later than upon physical handover of the product. Payment must be confirmed for the transaction to be finalised.

•    Products on order (Out of stock in Switzerland): The full amount is, in principle, payable upon confirmation of the order to initiate the procurement process. A deposit of up to 50% may be agreed in accordance with the terms of Article 9.

5.5 Security and anti-fraud measures: Dodeca Diamonds Switzerland reserves the right to request a copy of the Buyer’s identification document for any payment. For any purchase exceeding CHF 20,000 (including VAT), a certified copy of an identification document will be required. As part of the fight against fraud and money laundering, information may be passed on to the authorities or qualified third parties.

5.6 Payment incidents and retention of title (Art. 715 of the Swiss Civil Code): Dodeca Diamonds Switzerland retains full ownership of the products until the price has been paid in full (including taxes and charges). The Buyer undertakes to keep the products in perfect condition until payment has been made in full.

6. Buyer's Choice and Responsibility
 

6.1 Responsibility for choice : The Buyer acknowledges having reviewed the technical and aesthetic characteristics of the products. They select the products under their sole responsibility, according to their needs.

6.2 Compatibility and Use : The Buyer is solely responsible for determining the compatibility of the products ordered. Dodeca Diamonds Switzerland cannot be held liable for any error in judgment if the characteristics conform to the certificate.

6.3 Duty of advice and expertise : As diamonds are a highly technical product, it is the Buyer's responsibility, if they do not consider themselves sufficiently competent, to seek the assistance of an independent expert before any validation.

7. Delivery and Reception
 

7.1 Delivery Methods, Address and Confidentiality: Products are delivered exclusively to the address provided by the Buyer. For security reasons, the delivery address must match the Buyer’s identity (surname and first name).

  • In Switzerland: From 0 to 5,000 CHF via Swiss Post (Insured & Signature). From CHF 5,000 to CHF 15,000 via Malca-Amit via FedEx. Over CHF 15,000 via Malca-Amit only.

  • International and Europe: Shipments are entrusted to Malca-Amit, guaranteeing secure delivery via their own networks or via FedEx under the direct liability of Malca-Amit.

  • Discretion: The sender listed on the parcel is Dodeca Partners Sàrl. No reference to the contents or the brand appears on the outer packaging. No deliveries to PO boxes or ‘c/o’ addresses.​​

7.2 Insurance and Liability: Each consignment is fully covered by specialist insurance managed by Malca-Amit, corresponding to 100% of the actual invoice value. Malca-Amit assumes liability for transit, thereby exempting the customer from any financial loss, subject to compliance with verification procedures. The reference to “Zurich Insurance” has been removed from our protocols in favour of direct liability on the part of the cash-in-transit company Malca-Amit.

7.3 Delivery Terms and Security: A handwritten signature and presentation of an official identity document in the Buyer’s name are mandatory. Dodeca Diamonds reserves the right to arrange for delivery to be made personally by the Management.

7.4 Delivery times: Standard delivery times are 5 to 8 working days for Switzerland and 7 to 15 working days for international deliveries following confirmation of payment.

7.5 Tracking and Indemnity Clause: The customer can track their shipment in real time. Any instruction to ‘leave without signature’ or ‘leave at the entrance’ given unilaterally by the customer to the carrier results in Dodeca Diamonds being fully released from liability. In such cases, the transport insurance cannot be activated.

7.6 Customs charges and import formalities: For deliveries outside Switzerland, products are invoiced exclusive of VAT. All customs formalities, local VAT and import duties are the sole responsibility of the Buyer.

7.7 Obligations upon receipt (Art. 185 & 201 CO): Notwithstanding Art. 185 CO, the transfer of risk shall only take place upon actual delivery against signature. The customer must check the integrity of the packaging and the seal in the presence of the carrier. If the seal is broken, the customer must refuse the delivery and inform the Seller within 24 hours.



8. TRANSFER OF OWNERSHIP AND RISK
 

8.1 Transfer of Ownership : Ownership is transferred to the customer only after full payment of the price, regardless of the delivery date.

8.2 Transfer of Risk : Risk is transferred when the customer, or a designated third party, takes physical possession of the package (as evidenced by a handwritten signature). In the case of a drop-off instruction without a signature (Art. 7.5), risk is transferred upon delivery by the carrier.

9. Specific Orders and Customized Withdrawal Protocols
 

9.1 Scope : This clause applies exclusively to stones whose description or order confirmation expressly mentions a "right of return." This applies to any order specifically sourced at the Client's request (excluding stones physically present in Switzerland) or available on our website, and for which full payment has been received in advance.

9.2 Selection and Confirmation of Delivery Method : When ordering online, the Customer chooses their delivery method. This choice is systematically revalidated by Dodeca Diamonds during the order confirmation contact. Hand delivery is made either on the Riviera (VD), or via personalized delivery within Switzerland by Dodeca Diamonds Management (depending on the order amount and the customer relationship).

9.3 Inspection and Final Acceptance (pursuant to Art. 201 of the Swiss Code of Obligations): Upon personal delivery, the Client shall inspect the stone (the Client may, at their own expense, request the presence of their own expert). In accordance with Article 201 of the Swiss Code of Obligations, physical possession or signing of the delivery note constitutes acceptance of the goods and final approval. No claims for apparent defects or returns for personal reasons will be accepted after delivery.

9.4 Cancellation during inspection : If the Client decides, during the physical inspection only, not to finalize the purchase for reasons of personal convenience (justified by a serious reason), the sale may be cancelled on the spot. Dodeca Diamonds reserves the right to refuse any future transactions in the event of clear abuse or repeated cancellations (principle of good faith, Art. 2 CC), and may claim compensation for any damages incurred.

9.5 Liability for logistical costs (pursuant to Art. 189 of the Swiss Code of Obligations): In the event of cancellation as described in point 9.4, the Customer remains, by agreement contrary to the meaning of Article 189 of the Swiss Code of Obligations, fully liable for the costs incurred. The refund of the purchase price will be made after deduction of the actual logistical costs: secure international transport (to Switzerland and back to the original supplier), transit insurance costs, as well as non-refundable customs duties and taxes.

10. RIGHT OF WITHDRAWAL AND RETURNS
 

10.1 No statutory right of withdrawal (Swiss law): In accordance with Swiss law, the right of withdrawal does not apply to diamonds and precious stones sold by Dodeca Diamonds Switzerland, due to their unique nature and value. Any request for a return or refund must first be accepted in writing by Dodeca Diamonds Switzerland. No withdrawal will be possible without the company’s explicit consent. As a matter of commercial courtesy, the Seller will only consider a return for products with a proven defect or total non-conformity with the certificate of authenticity provided.

10.2 Items strictly excluded from return and refund: In accordance with standard practice in the high-end gemmology sector, no returns, exchanges or refunds will be accepted for:

•    Products made to specific order: Stones sourced specifically at the Buyer’s request.

•    Personalised creations: Any piece of jewellery made to measure, engraved, cut to size or modified on request.

•    Product alteration: Stones cut or modified after delivery, products showing signs of wear, assembly or testing.

•    Broken seal: Any product whose security seal (laboratory box or Dodeca seal) has been broken or opened.

•    Documentation: Any item for which the original certificate of authenticity or specific packaging has been lost or damaged.

10.3 Return Policy (Stock Items Only): For standard products held in stock at our warehouse in Switzerland, a return request may be considered subject to the following conditions:

10.3.1 Time limit for complaints: Any defect or non-conformity must be reported in writing (by email) within 48 hours of receipt, accompanied by photographs and a detailed description.

10.3.2 Return period: Following written approval from the Seller, the Buyer has 5 calendar days to dispatch the product.

10.3.3 Condition of the product: The item must be returned unused, in its exact original condition, with its case and original certificate of authenticity.

10.3.4 Costs and Risks: Return costs and secure insurance are the sole responsibility of the Buyer, except in the event of a proven delivery error on the part of Dodeca Diamonds Switzerland. The return must be made via a secure, tracked and insured delivery service for the actual value of the item.

10.4 Refund procedure: * Verification: Upon receipt of the returned item, our gemmologist will carry out an assessment (checking the laser inscription, inclusions and weight) to confirm that the stone matches the one sold. If the assessment is satisfactory, the refund will be processed via the same payment method within 10 working days, less any non-refundable bank transaction fees.

  • Rejection: If the return is rejected (failure to meet the above conditions), the item will be returned to the Buyer at their sole expense.

10.5 Nature of the products: The Buyer acknowledges that stones, crystals and minerals are natural products that frequently contain inclusions, cracks or cavities. These characteristics form part of the item’s identity and do not constitute valid grounds for a return. Only proven non-conformity with the certificate of authenticity (GIA, HRD, IGI) may justify a return.

11. GUARANTEE, AUTHENTICITY AND CONFORMITY
 

11.1 Certifications and Authenticity: Dodeca Diamonds Switzerland is committed to selling only diamonds and gemstones of the highest quality. Each item (weight ≥ 0.15 ct) is accompanied by an original certificate of authenticity (GIA, HRD or IGI) guaranteeing the authenticity, provenance and specific characteristics of the product. The Buyer acknowledges that this certificate constitutes an authoritative independent appraisal.

11.2 Guarantee of Conformity (Art. 197 CO): The Seller guarantees that the product delivered corresponds in every respect to the description in the certificate and the order confirmation. These provisions shall in no way deprive the Buyer of the statutory guarantee provided for by the Swiss Code of Obligations, which requires the professional seller to guarantee the buyer against hidden defects.

11.3 Distributor Status and Limitation: The Buyer is hereby informed that Dodeca Diamonds Switzerland is not the manufacturer (cutter or producer) of the products offered and shall not be held liable for any damage resulting from defective products beyond the certified specifications. Unless expressly stated otherwise, no other contractual warranty applies.

11.4 Ethical Origin Guarantee: We declare that we strictly adhere to the Kimberley Process and United Nations resolutions, guaranteeing that all our diamonds come from legitimate ‘Conflict-Free’ sources, not involved in the financing of armed conflicts.

11.5 Natural Characteristics and Exclusions: The Buyer is advised that the natural characteristics of the stones (inclusions, marks, natural fissures), as detailed in the ‘Product Characteristics’ section, form an integral part of their identity and value; they do not constitute a defect. The warranty also excludes:

  • Natural wear and tear, loss, theft or accidental breakage after the transfer of risk.

  • Any damage resulting from improper handling or negligence.

  • Third-party intervention: Any damage resulting from the intervention of an unauthorised third party (e.g. setting error or alteration by an external jeweller) shall release the Seller from all liability. ​

11.6 Duty to inspect and notification of defects (Art. 201 CO): In accordance with Swiss law, the Buyer is obliged to inspect the condition of the stone upon receipt.

•    Time limit: If the Buyer discovers any defects or non-conformities, they must notify the Seller immediately, and in any event within 48 hours.

•    Acceptance: In the absence of such notification within this time limit, the item is deemed to have been accepted by law, except in the case of hidden defects that cannot be detected during the usual checks.

12. LIMITATION OF LIABILITY
 

12.1 Force Majeure and Availability : Dodeca Diamonds Switzerland shall not be held liable for non-performance of the contract in the event of stock shortage or product unavailability resulting from a force majeure event. Such events include, but are not limited to: natural disasters, fires, cyberattacks, disruptions or total or partial strikes affecting postal services, carriers (Malca-Amit, FedEx, La Poste, etc.) and means of communication or telecommunication.

12.2 Indirect Damages : The Seller disclaims all liability for indirect or consequential damages (loss of business, loss of profit, loss of opportunity, commercial loss) that may arise from the purchase or use of the products. In any event, its liability is strictly limited to the amount of the order actually received.

12.3 Computer Data : Dodeca Diamonds Switzerland cannot be held responsible for any loss of data or files occurring while browsing the website. It is the Buyer's sole responsibility to perform all necessary backups and to secure their own computer equipment against any intrusion or virus.

12.4 Third-Party Content and Hyperlinks : The site may contain information from third parties or links to external websites. The Seller shall under no circumstances be liable for damages resulting from the use of, access to, or inability to use this third-party information, nor for the content of the sites to which these links point.



13. DATA PROTECTION AND CONFIDENTIALITY
 

13.1 The personal data collected from the Buyer is necessary for processing the order, issuing invoices and combating fraud.

13.2 This data is processed in accordance with the Federal Data Protection Act (LPD) and may be communicated to the Seller's partners responsible for execution, management, processing, payment and secure delivery (Malca-Amit, banking institutions).



14. APPLICABLE LAW AND JURISDICTION
 

14.1 Applicable Law : These General Terms and Conditions and the resulting contractual relationships are governed exclusively by Swiss law.

14.2 Legal jurisdiction : For any dispute relating to the interpretation or execution of these terms, the exclusive legal jurisdiction is located in La Tour de Peilz (Vaud), Switzerland.



15. SPECIAL PROVISIONS (PRESTIGE AND INVESTMENT RANGE)
 

15.1 Prestige or Investment grade diamonds are subject to specific contracts or personalized mandates. We invite our clients to contact us directly for these specific contractual terms.
